Settlement of (limited) community of property

In the case of marriage, and subsequent divorce, there are always questions concerning the distribution of assets and debts. This depends on the matrimonial property regime within which you were married.

Full community of property

If you did not get married with an antenuptial contract, and you were married before 1 January 2018, you will be married in full community of property. This means that all assets and debts are shared in full by the spouses.

Limited community of property

Did you get married after 1 January 2018 without a prenuptial contract? If so, you were married in limited community of property. This means that everything that was not acquired before the wedding will also remain private after the divorce. In addition, all inheritances and gifts are determined as private in advance by law. All assets accrued during the marriage will however be deemed community of property.
