Statutory indexation rate effective 1 January 2022: 1.9%

Pursuant to the law, the amount of child and spousal support established by a court or by agreement is automatically indexed by a certain percentage as of 1 January.

The amount of the indexation is determined by the Minister for Legal Protection. This takes into account the average increase in salaries and the price level. For 2022 the indexation rate for child and partner support has been set at 1.9%.

This means that as of 1 January 2022 the amount you pay or receive monthly in child support or spousal support will be increased by 1.9%. The increase will take effect automatically.

Incidentally, it is possible to deviate from the statutory indexation by mutual agreement. For example, you can exclude the indexation or agree on an alternative method of indexation.

If indexation has not been applied in recent years, you may reclaim the overdue indexation with retroactive effect. The right to recover overdue maintenance or indexation lapses after five years.
