Wist u dat u ook onderhoudsplichtig kunt zijn voor uw stiefkinderen?

De wet bepaalt dat stiefouders onderhoudsplichtig zijn jegens hun stiefkinderen. Deze verplichting geldt alleen zolang de stiefouder gehuwd (of geregistreerd partner) is met een persoon die een of meer kinderen heeft. Is er geen huwelijk (of geregistreerd partnerschap) maar wordt er alleen samengewoond, dan is er voor de ‘stiefouder’ ook geen wettelijke onderhoudsplicht. Als het huwelijk van de stiefouder eindigt, bijvoorbeeld door echtscheiding, dan eindigt ook de onderhoudsverplichting voor de stiefouder.

De onderhoudsplicht geldt verder alleen ten aanzien van de kinderen van de echtgenoot (of geregistreerd partner) die tot het gezin behoren. Dit moet ruim worden geïnterpreteerd.
